<br />FOR AND IN CONSIDERATION OF the sum of Fifteen Thousand and

<br />no/100 Dollars ($15,000.00) ,RUBY R. MENZER, a resident of El Paso County,
<br />clo Kenneth Geddes, Attorney, 513 Mining Exchange Building, Colorado
<br />Springs, Colorado 80903, hereinafter referred to as Lessor, warranting owner-
<br />ship or the right to lease the real property hereinafter described, hereby
<br />leases to SCHMIDT CONSTRUCTION, INC., a Colorado corporation, 81;.0 W, 49th
<br />Avenue (P .O. Box 545) ,Arvada, Colorado, hereinafter referred to as Lessee,
<br />the exclusive right to mine and remove for a period of Three (3) years (con-
<br />secutiye) from the date hereof, all rock, gravel, sand and other minerals suitable
<br />for rip rap or aggregates in, or under the following described real property
<br />located in El Paso County, in the State of Colorado, to-wit:
<br />A part of the Northwest quarter of Section 32, Township
<br />16 South, Range 67 West of the 6th P.M. in E1 Paso County,
<br />Colorado, more particuiarly described as follows:
<br />Beginning at the Northwest corner of said Section 32;
<br />thence S 1°02'55" W (Basis of Bearing) along the Westerly
<br />line of said Northwest quarter, 1320.00 feet; thence N
<br />890 25' 08" E, 378.00 feet; thence N 1°02'55" E, 375.00 feet;
<br />thence N 89°25'08"E, 1404.74 feet; thence N 0°47'14" E,
<br />80.00 feet; thence S 89°25'08"W, 160.00 feet; thence
<br />N 0°47'14" E, 355.00 feet; thence N 89°25'08" E, 50.00 feet;
<br />thence N 0°47'14" E, 160.00 feet; thence N 70°35'35" W,
<br />1021.61 feet to the Northerly line of aforesaid Northwest
<br />quarter; thence S 89°27'57"W along said Northerly line,
<br />700.00 feet to the point of beginning. Containing 35.38
<br />acres, more or less;
<br />RESERVING AND EXCEPTING unto Lessor, her heirs,
<br />successors, executors and assigns, all oil, gas and other
<br />hydrocarbons, all water and water rights, all metallic
<br />ores, and all flagstone and/or moss rock or building stone
<br />of a decorative or building grade, the above property
<br />being hereinafter referred to as the "leased premises" .
