(3) Documents and related information supporting a finding of effective control of the <br />lands to be included in the LMU. <br />Western Fuels-Utah, Inc. and Water Users Association Number One of Rangely <br />are the only surface owner other than the Federal Government within the <br />boundaries of the proposed LMU. <br />Western Fuels-Utah, Inc. owns the following surface: <br />T. 3 N.. R. lO1W.. 6th P.M.. <br />J sec. 29: El/2NW1/4, NEl/45W1/4, Nl/2SE1/4, Sl/2NE1/4, <br />NW 1/4NE1/4. <br />Water Users Association Number One owns the following surface: <br />T. 2 N., R. 101 W„ 6th P.M., <br />sec. 11: lot 6 (containing 64.72 acres)` <br />sec. 12: lot 5 (containing 15.28 acres)' <br />" Some acreage (less than 4 acres) was not sold to Water Users Association Number <br />J 1, but was reserved for highway purposes as described in Book 128, Page 347 of <br />the public records of Rio Bianco County. <br />_~ (4) Sufficient data to enable the authorized officer to determine that MER of the <br />Federal recoverable coal reserves will be achieved by establishment of the LMU. <br />I~ If a coal bed, or portion thereof, is proposed not to be mined or to be rendered <br />uttmineable by the operation, the operator/lessee shall submit appropriate <br />I' justification to the authorized officer for approval. <br />The application for the approval of the modified Resource' Recovery and <br />' Protection Plan, which is being submitted simultaneously with the LMU <br />application, provides the required information. <br />' As discussed earlier, of the eight coal beds identified, only two beds, D and B <br />8 <br />
