<br />-a- <br /> <br />Please supply the Division with a copy of a letter from the <br />Colorado Department of Health ae to whether the importation of <br />mine waste from Dowe Flats to the Lyons Quarry Site (Permit <br />No. M-77-208) requires a Certificate of Designation permit or <br />you are in the process of obtaining one. <br />3. Exhibit D - Phased Minina Plan - Concerning the document <br />entitled "P_hasing of Mining and Reclamation. Dowe Flats <br />Project" dated October 8. 1993, the Division has the following <br />questions and requests: <br />a. On page 1, it is stated that "the average maximum <br />annual disturbed acreage over the life of the <br />project will be 100 acres or less." What is the <br />maximum disturbance at any one time during the life <br />of the project? <br />b. On page 4, you state that a cover crop will be <br />planted to provide a quick vegetative cover on areas <br />that have been topsoiled and that "...At this point <br />in time, the classification of disturbed acreage no <br />longer applies." This is not true. The final seed <br />mix must be planted and established in compliance <br />with the provisions of Rule 6 standards before the <br />area can be removed from the disturbed or affected <br />area category. Therefore, areas stabilized with a <br />cover crop will need to be included in the <br />reclamation bond for final plant mix seeding and <br />vegetation establishment. <br />c. Table 1 - Indicates the maximum disturbed acreage of <br />115 acres will occur in year 10. Does this include <br />the acreage that has been revegetated with a <br />temporary cover? <br />d. Regarding Figures 4, 5, 6, 7 and 8 - Are the areas <br />designated "reclaimed" referring to establishment of <br />final vegetation as required by Rule 6 of the Rules <br />and Regulations of the MLRB? In other words, would <br />these areas be eligible for total bond release? Are <br />areas designated "disturbed" just those where <br />material is being moved? <br />If the project stops at any given time, the Division <br />would have to place topsoil on active waste rock piles. <br />Therefore, where are the topsoil stockpiles located <br />during these years? Are they in separate areas from <br />waste rock atockpilea or will all topsoil be hauled <br />directly to the final location on the waste rock <br />atockpilea? <br />
