Lnnp <br />Division D~reclor <br />The Division of Minerals and Geology (DMG) received your letter on <br />January 8, 1998 regarding the technical adequacy review for the <br />Baseline Resource application. The responses are mostly acceptable <br />to the Division. Your draft letter for condition of permit <br />approval was received via facsimile today and has been reviewed. <br />The DMG will approve the application with the following condition: <br />CONDITION OF PERMIT APPROVAL <br />The operator must do one of the following four options: <br />1. Provide an alternate reclamation plan which shows Phase 2 and <br />3 as groundwater lakes. The operator will show evidence of <br />compliance with the Office of the State Engineer, Division of <br />Water Resources for this end use prior to exposure of <br />groundwater in Phases 2 or 3. <br />2. Provide a design for the slurry wall done by a registered <br />professional engineer. This design will be incorporated into <br />the permit as a construction quality assurance plan and will <br />be enforceable by DMG. Also, the Operator will provide a <br />monitoring program for construction of the slurry wall to <br />assure it is constructed according to plan and will provide a <br />testing program to determine if the slurry wall is constructed <br />properly. The Operator will provide a financial warranty for <br />the amount of 25~ of the construction cost of the slurry wall. <br />
