The Division of Minerals and Geology (DMG) received your letter on
January 8, 1998 regarding the technical adequacy review for the
Baseline Resource application. The responses are mostly acceptable
to the Division. Your draft letter for condition of permit
approval was received via facsimile today and has been reviewed.
The DMG will approve the application with the following condition:
CONDITION OF PERMIT APPROVAL
The operator must do one of the following four options:
1. Provide an alternate reclamation plan which shows Phase 2 and
3 as groundwater lakes. The operator will show evidence of
compliance with the Office of the State Engineer, Division of
Water Resources for this end use prior to exposure of
groundwater in Phases 2 or 3.
2. Provide a design for the slurry wall done by a registered
professional engineer. This design will be incorporated into
the permit as a construction quality assurance plan and will
be enforceable by DMG. Also, the Operator will provide a
monitoring program for construction of the slurry wall to
assure it is constructed according to plan and will provide a
testing program to determine if the slurry wall is constructed
properly. The Operator will provide a financial warranty for
the amount of 25~ of the construction cost of the slurry wall.
