<br />M-98-055/Adequacy letter <br />7/2/98 <br />page 4 <br />The pit is depicted as filling the entire 9.99 acres. However, the mining plan stated that stockpiles <br />would be above and outside the pit, and that reclamation would be performed after all mining was <br />finished. How is the full 9.99 acres mined without moving the stockpiles during mining? <br />I have observed a graded dirt road in the northeast corner of the site during my inspections. <br />There is no road shown here on either map. Please include it, plus indicate where others maybe <br />during and after mining. <br />Exhibit G -Source of Legal Right to Enter <br />There is a small error in the location described in this exhibit. Though the section and township <br />information is correct (which alone would properly indicate the county wherein this is), the notary <br />has again written "Hinsdale" County, apparently as the county where this pit is located. This <br />should probably be corrected, so there is no discrepancy in the locations noted in the application. <br />Exhibit I - Proof of Filing with County Clerk and Recorder - <br />The receipt for certified mail, addressed to the clerk, is not accompanied by the corresponding <br />postmarked, signed return receipt. If you have the correct return receipt (#Z 240 620 348) please <br />submit it. The one you included here should accompany one in Exhibit J. <br />Exhibit J - Proof of Mailing Notices of Permit Application <br />There are several certified receipts included here. One of them addressed to the county <br />commissioners (#Z 240 620 320) contains the notation "never received," though its signed return <br />receipt is actually included in Exhibit I. The one apparently sent later, overnight, to replace it (#Z <br />240 620 349) however is accompanied by a signed receipt of proof of delivery. <br />Exhibit L -Permanent Man-made Structures <br />As noted above, there is some question about the completeness of the list of the structures <br />identified in the application. Please revise this exhibit appropriately, including the names of each <br />structures' owners, plus a damage agreement as needed. <br />Additional Items <br />You are to begin publication of the legal notice, as instructed in the Division's "completeness" <br />letter to you recently. Please ensure that all details of the legal description are correct, as well as <br />the date of the end of the public comment period. If you have questions about preparing the <br />notice, please call me. When the publication has finished, you must send me the publisher's <br />affidavit of publication. <br />Using the same language in the published notice, please send certified mailings to all owners of <br />property within 200 feet of the boundary of the permit. As noted above, the entity which "owns" <br />the state highway plus the landowner of the property east of the highway are two parties which <br />
