.~

M-98-055/Adequacy letter
7/2/98
page 2
unless I have misinterpreted this information.

The Township number, however, is incorrect. Again, as verified by following exhibits, it seems it
should be Township 46 North, not 45 North. I have manually corrected this, and no further
clarification is needed, unless this is not satisfactory to you.
Application certification, page 6
The notarized signature seems to have been modified by the notary. You indicated "Gunnison"
County, whereas she struck that and wrote "Hinsdale". We both know the site and your
residence are in Gunnison County, so perhaps she simply revised this based on the location of the
notarization. This is brought to your attention only, and does not constitute a problem or need to
correct anything.
Exhibit A -Legal Description
This is correct except for the apparent switching of the words "West" and "North" in the first line.
The location should read "Township 46 North, Range 4 West..." I have manually corrected this,
and the exhibit may stand as is, unless my correction is unsatisfactory or you wish to submit a
corrected version.
Exhibit B -Site Description
The materials describe the site well except for the existing vegetation. The north half of the site
has not been disturbed by mining, and the range vegetation presumably still exists. Please provide
a brief description of the vegetation present on the site.
The statement is made that the only structure within 200 feet is the highway. Please be reminded
that fences, gates, cattleguards, roads, and communication lines are also considered structures. If
necessary, please revise the list of structures to include all such items.
Exhibit C -Mining Plan
You state that all topsoil and overburden will be salvaged prior to aggregate extraction. Exhibit
B stated the topsoil depths vary from 0 to 12 inches, and this exhibit states that overburden depths
vary from 0 to 12 inches. All material will be stockpiled for use in reclamation, but you do not
indicate whether these two materials will be stockpiled separately from each other, where on the
site the stockpiles will be, or how the topsoil will be stabilized while stockpiled. Please provide
this information.
You mention a mobile "plant site" but do not provide any details as to what type of (processing)
plant i[ is. Also, there is no indication of the types of mining equipment you expect to use. Please
provide these.
