The applicant <br />responded favorably to a suggestion by the Division that he develop a plan to revegetate <br />portions of the granite quarry that he would otherwise have only been required to leave in <br />astable highwall condition. The applicant has committed to reclaiming the entire area of <br />disturbance. However, some areas are planned to be reclaimed to commercial tourism final <br />land uses which would entail leaving some mine facilities in place. <br />2. "I do not believe that a commercial building can remain on the property upon reclamation, <br />since i[ is not zoned commercial by Fremont County." <br />(M. Brown, J BroN~n) <br />Response -Fremont County approved the applicant's special use permit and was afforded <br />the opportunity to review and comment on the application submitted to DMG. The county <br />provided no comments; therefore, the Division assumes the applicant will have the legal <br />right to reclaim the mine as planned. <br />"The applicant has avoided a commitment to salvaging all topsoil. possible, and has not <br />committed to reclaiming any specific amount of land." <br />(ibL Brown,. The <br />authors now call for reclamation only after all mining operations have been completed." <br />(J L. Clark) <br />Response -The applicant's plan is to conduct concurrent reclamation of the gravel areas. <br />The quarry areas will also be reclaimed concurrently as much as possible. The applicant's <br />timetable for reclamation activities is spread evenly over the expected 37-year life of the <br />mine. <br />Application Exhibit G -Water Information: <br />"There is a well with cyanide contamination 1/8 mile from Mr. and Mrs. James E. Clazk's <br />well. Also, they believe there is a well with cyanide on the proposed site. What will happen <br />if these wells are disturbed?" <br /> <br />
