<br /> <br />Page ] 2 <br />Response - If application approval is granted, the applicant will be responsible for <br />maintaining disturbances within the permit boundary on his property. Any off-site <br />disturbanceswould be considered a violation of the Mined Land Reclamation Act, and the <br />applicant would be subjected to civil penalties and/or corrective actions, in addition to <br />recourse by the landowner. The application indicates that the permit boundary will be posted <br />at the line between the railroad right-of-way and the remainder of the ranch. <br />8. "I am worried about possible ground contamination from the refueling and possible over <br />filling of the gas tanks on their mobile equipment." <br />(M Brown, J. Brown) <br />Response -The Division has reviewed the applicant's fuel storage plans and refueling plan, <br />which indicates that all equipment will be refueled at the fuel storage azea. The fuel storage <br />area is designed to contain approximately 140% of the 10,000-gallon storage tank capacity. <br />The bentonite clay liner will be compacted to a permeability of 1 x 10-6•, and this will contain <br />a spill, until it can be cleaned up and disposed of properly.. <br />9. "The increased size would have an adverse affect which has not been studied in enough <br />depth." <br />(G. Glab) <br />Response -The Division is unable to determine to what this comment refers and ish'E erefore ~_ <br />unable to provide a response. <br />Application Exhibit E -Reclamation Plan <br />"Quantity of soil has been systematically sidestepped by the applicant." <br />(M Brown, J Brown) <br />Response -The applicant provided soil survey information, including a chart of soil salvage <br />from all locations to be disturbed, and has committed to topsoil placement of upon <br />reclamation. The informationprovided, indicatesthe applicantplans to salvage all available <br />top soils, plus some material that would not necessazily be considered topsoil for <br />reclamation purposes. The applicant plans to reclaim more azea than can be covered by the <br />topsoil currently available. Therefore, he has committed to increasing the amount of area to <br />be revegetated and will accomplish this by mixing crusher fines with soil, in order to <br />increase the amount of planting medium available for reclamation.
