for additional information on water rights and augmentation. Given these considerations, there
is little to no potential for diminution of water quality or quantity relative to other water rights
holders.
E. The size of the impoundment shall be adequate for the intended use
The beneficial and intended use of a permanent impoundment is to water livestock during the
regularly scheduled and relatively short spring time grazing period. There is a need on the
grazing lands of Silver Spur for a water source for livestock which Pond F has satisfied for many
years, There will be an increase in need in the future as other mine ponds are reclaimed or
privatized. The size and typical water storage provided by Pond F is very similar to livestock
ponds constructed by local ranchers and should be very adequate for the intended use. The
pond was sized and designed to contain a 3-year accumulation of sediment (under disturbance
conditions) for the contributing watershed. Given that the future watershed will essentially be
"undisturbed°, it is expected that the pond will hold well over 3 years of sediment and may in
reality never require Geanout.
F. The impoundment shall be suitable for the approved post-mining land use
Under the mining pemtit, the post mining land use is for agriculture use inGuding livestock
grazing and as open range for wildlife. Pond F is considered suitable to meet these beneficial
needs. It will provide an additional watering hole, outside of the natural drainage bottoms. It will
provide water during the precise time of year when grazing will occur in the area. During times
of drought, such as the last few years, the pond will provide much needed water to wildlife
supplementing natural sources.
Permanent Pond FDocumentation -Exhibit 42C Page 4
