Whether the applicant has demonstrated to the Division's <br />satisfaction that there will be appropriate measures taken to <br />protect, or minimize impacts to, wildlife and fisheries. <br />III. WITNESSES AND EXHIBITS <br />The parties shall be limited to the exhibits they submitted at <br />the prehearing conference. <br />All documents, exhibits and photographs presented as evidence <br />at the hearing will become part of the administrative record. Upon <br />request, a party may recover any evidence introduced by that party <br />if no action for judicial review is commenced within thirty days of <br />the date agency action in this matter becomes effective. <br />IV. <br />The parties shall make their presentations in the following <br />order. The time limits set out below are maximum limits and shall <br />be strictly enforced. The Board, in its discretion, may allow <br />additional time when warranted. The Board has the right to limit <br />any redundant testimony. Unused time may be used in subsequent <br />closing statements as applicable. At the conclusion of each <br />presentation, there will be an opportunity to conduct cross- <br />examination of any of the witnesses that testified during the <br />presentation. <br />1. Division introduction. <br />The Division shall have 5 minutes in which to present an <br />introductory overview of the application. <br />2. Applicant presentation. <br />Summit Brick and Tile Co. shall have 5 minutes in which to <br />make its presentation to the Board. <br />3. Division presentation. <br />The Division shall have 5 minutes in which to present its <br />recommendation to the Board. <br />4. Public comment period. <br />Members of the public, not party to this action, shall have an <br />opportunity to address the Board. The Board has set a time limit <br />for such comments at 10 minutes collectively. <br />5. Applicant closing statement. <br />Summit Brick and Tile Co. shall have 5 minutes in which to <br />make a closing statement. <br />- 2 - <br />
