M-93-OSO, APPROVAL OF APPLICATION This Prehearing Order is proposed to the Mined Land Reclamation Board ("Board") by the prehearing conference officer to govern the hearing in this matter. This order, as amended by the Board, shall be effective upon approval by the Board. I. PARTIES 1. The following appeared at the prehearing conference and were admitted as parties: a. Summit Brick and Tile Co. 2. The Division of Minerals and Geology ("Division") shall not be a party, but shall participate in the hearing as staff to the Board. Persons formerly objecting were not present at the prehearing conference, although they were duly notified. They will have an opportunity to speak as members of the public at the hearing, if they wish, but shall not be afforded party status. II. ISSUES TO BE CONSIDERED Presentations to the Board shall be strictly limited to the issue of whether the pending application complies with the requirements of the Colorado Mined Land Reclamation Act and the regulations promulgated by the Board. The parties shall limit presentations to the question of whether the pending application should be approved or denied, based on the issues stated below: 1. Whether the applicant has demonstrated to the Division's satisfaction that there will not be an adverse impact to local groundwater supplies, including both quality and quantity; 2. Whether the applicant has demonstrated to the Division's satisfaction that there will not be an adverse impact to surface water, specifically in Bracket Creek;
