• Mr. Commissioner <br />• following Resoluti~?n: <br />_~~. ~4.t,Q1 ___ moved tine adoption of the <br />RESGLUTIGN NG. $5 <br />Series of 1387 <br />Issuance of Congitional Use Pe~~3~~2e1i~II~~~E_~Z=121 <br />BE IT RESOLVED by the Board of County Commissioners of <br />Fremont County: <br />THAT WHEREAS, Energy Fuels Coal, Inc. (Losdout), (hereafter <br />"Applicant") has made application for issuance of a Conditional <br />Use Permit pursuant to Section 600 B of the current zoning <br />resolution of Fremont County to operate a coal loadout facility <br />which application has been designated as CUP 87-17; and <br />WHEREAS, the Board of County Commissioners held a public hearing <br />concerning said application on September 22, 1387, at which time <br />comments and evidence were considered, including all materials <br />contained as part of the application and which were in the <br />county's file concerning the application; and <br />WHEREAS, it appears that issuance of a Conditional Use <br />Permit is appropriate; <br />NOW THEREFORE, BE IT RESOLVED by the Board o. County <br />Commissioners of Fremont County that: <br />1. The Board of County Commissioners of Fremont County <br />make the following findings with respect to the application for <br />issuance of a Conditional Use Permit to Applicant as follows: <br />a. The procedure requirements Section 600 B of the <br />current Fremont County zoning resolution have been <br />met. <br />b. The location of the proposed use is compatable <br />with ~?ther land uses in the area and does not <br />place an undue burden on existing transportation, <br />utilities, and service facilities in the vacinity. <br />e. The site is of sufficient size. <br />d. The site will be served by streets and roads of <br />sufficient capacity to carry the traffic gcneratad <br />by the proposed use, and the proposed use will nct <br />result in undue traffic congestion or traffic <br />hazards. <br />• <br />~J <br />Revised 12/01/87 <br />
