The Division's approval of the proposed control plan is based on the submitted transferring and <br />stockpiling quantities as listed below. Prior to any increase in annual transferring rates and <br />stockpiling quantities, the applicant shall submit a Revised Air Pollutant Emission Notice and <br />Control Plan which will be subject to Division review and approval to ensure compliance with <br />the National Ambient Air Quality Standards for particulate matter. Annual records of the actual <br />transferring rates shall be maintained by the applicant and made available to the Division for <br />inspection upon request. <br />Throughput of coal conveyed, unloaded, and screened shall not exceed 1,400,000 tons/year. <br />Clean coal stockpiles shall not exceed a m9ximum of 1 10,000 tons at any one time. <br />8. At all times, including periods of start-up, shutdown, and malfunction, the facility and control <br />equipment shall, to the extent practicable, be maintained and operated in a manner consistent <br />with good air pollution control practices for minimizing emissions. Determination of whether <br />or not acceptable operating and maintenance procedures are being used will be based on <br />information available to the Division, which may include, but is not limited to, monitoring <br />results, opacity observations, review of operating and maintenance procedures, and inspection <br />of the source. <br />7. A revised Air Pollutant Emission Notice (APEN) shall be filed when a significant change in actual <br />• emissions occurs (above the level reported on the last APEN, submitted to the Division) as <br />required by Regulation No.3, Part A.I1.C.2 as per the timetable in Regulation No.3, Part A.I1.C.3. <br />In accordance with C.R.S. 25-7-114.1, the Air Pollutant Emission Notice (APEN) associated <br />with this permit is valid for a term of five years. The five year term for this APEN expires on <br />April 26, 2001. A revised APEN shall be submitted no later than 30 days before the five year <br />term expires. <br />3/0028/005 <br />
