This office has reviewed the contained <br />plan of operations and prepared an environmental assessment of the project in <br />which several additional concerns and mitigation measures were identified. <br />Subject to these additional measures, to be attached as stipulations in the <br />final permit, the plan of operations was found to be satisfactory and complete <br />and is approved. <br />The permit area is located entirely within the Brick Nos. 2 and 7, two <br />unpatented mining claims located prior to the passage of Public Law 167, July <br />23, 1955, from which cinder materials can be removed under the General Mining <br />Law. The western and northern boundaries of the permit area abut post-1955 <br />claims, the Brick Nos. 9 and 10, from which removal of common variety cinder <br />materials is strictly forbidden. To assure the cinder removal is indeed only <br />occurring within the permit area from the pre-1955 claims we will require: <br />1. The operator will accurately locate and permanently monument, at a <br />minimum, the southwest and northwest claim corners of the Brick No. 7 <br />claim. <br />The operator, who is also the claimant of record for the unpatented claims on <br />which mining is to take place, has relinquished all timber management rights <br />to the BLM. Dotsero Block is entitled to cut and clear timber to provide <br />clearance for mining or mining related operations, whereas BLM is allowed to <br />manage the timber provided that such management does not materially interfere <br />with ongoing mining operations. To allow BLM to dispose of as much timber as <br />possible before it would otherwise be lost and wasted to clearance in advance <br />of mining we stipulate: <br />
