Feb-05-07 11:34A Phillips County <br />We do not anticipate encountering the water table if mining only goes to a depth of <br />2U feet. We will commit to limiting the excavation to a minimum of two (two) feet <br />above the groundwater surface attd to immediately hacklill any exposed <br />groundwater should it accidenlapy be encountered during the mining operation. <br />(i.3.12 F.XlI1BTT I,- PCrnianent Man-Made Structures <br />3. The applicant specifies there arc tow (2) electric power poles in the pit area, i.e.: <br />within 2UU feet of the excavation, that are owned by Y-W 6lcctric. Please <br />demonstrate; how the applicant will comply with Ttule 6.3.12. Applicable options <br />:tvailablc to the applicant arc as follows; <br />a) Provide a notarized agreement between the Applicant and the Petson(s) <br />having an interest in the stntcturc, that the Applicant is in provide <br />contpunsation for any damage to the struchtrc; or <br />h) Whcrc such an agreement Cannot be soothed, the Applicant shall provide an <br />appropriate engittccring evaluation that demonstrates that such structure shall <br />not he dantaged by activities occurring at the mining operatiatt; ur <br />c) Where such structure is a utility, the Applicant may supply a notarised letter, <br />on utility letterhead, from the owner(s) of the utility that the mining and <br />reclamation activities, as proposed, will have "nu negative effect'' on their <br />utility. <br />We have been in contact with Y-W Electric Associatiiou regarding their power poles. <br />Mr. David Allen of Y-W should have sent you a letter indicating that they plan to <br />retire that lint. As it is retired, they plan to remove the poics in question. These <br />structures will no longer he an issue as the sand is mined. <br />Attached as part of this response is a copy of the Proof of Publication and proof of <br />mailings to adjoining landowners. A sitmed copy indicating this information has bectt <br />filed with the Yuma County Clerk is also attached. if any additional information is <br />required, please give me a call at )70-854-3778.
