We have not to date, but will if you request <br />confidentiality. <br />~~, What is the anticipated life of this mine? <br />a~~ <br />Exhibit E - Reclamation Plan <br />t~ We would concur with the recommendations made by Mr. Puga. <br />~~,~~What wil] be the gradient of the final slope? <br />~~.,Any compacted areas should be ripped to increase the potential for <br />reclamation success (e.g., access road, plant site). <br />Is the operator planning on importing topsoil to this site as specified <br />~~~in the SCS report? <br />Exhibit L - Reclamation Costs <br />We believe there is some confusion over the rationale for presenting <br />reclamation costs. The costs that are eventually approved by the Board are <br />what will be posted by the operator as financial warranty. The financial <br />warranty is held by the State of Colorado to guarantee reclamation of this <br />site occurs. If for some reason the operator were to go out of business, the <br />State would cash in the financial warranty and have the site reclaimed by a <br />contractor (after putting out requests for proposals). Therefore, we need to <br />have reclamation costs separate from what it would take Mr. Berends to reclaim <br />this site. <br />Please provide costs for reclaiming this site taking into consideration the <br />maximum amount of acres to be disturbed at any one time (including access <br />road, process area, area being mined and area previously mined being <br />reclaimed). Based on Caterpillar Performance Handbook and Blue Book Rental <br />for Colorado, we have calculated topsoil costs of $0.83 per cubic yard and <br />grading at $75.00 per acre. Please use these values plus the values provided <br />by Mr. Puga in formulating the reclamation costs for this site. The costs <br />should be presented per category on an acreage basis and then totalled by the <br />maximum acreage disturbance. It should be noted that it will take a couple of <br />years before the planted species have sufficiently expressed themselves, <br />pursuant to Rule 6.5. Therefore, it will be necessary to present costs for <br />the reclaimed areas in case of failure. <br />Exhibit M - Local Government Approval <br />When will the Special Use Permit be issued by Elbert County?
