The Division of Minerals and Geology (Division) is required to make an approval or denial decision no later than August 28, 2000, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as possible. 1. As required by Rule 1.6.3, please submit the proof of publication of the public notice circulated in the local newspaper. Proof of notice may be return receipts of a Certified Mailing or by proof of personal service. 2. Please submit the proof of notice to all owners of record of surface lands, mineral owners, easement holders, and owners of record of surface lands that are within 200 feet of the boundary of the affected land. Proof of notice may be return receipts of a Certified Mailing or by proof of personal service. Rule 6.3.2 Exhibit B- Site Description 3. The applicant states that there are no permanent man-made structures with 200 feet of the affected area. Please be aware that above and below ground utilities and roads are considered permanent man made structures as defined by Rule l .l(48). In addition, all permanent man made structures within 200 feet of the affected area will need to meet the performance standards of Rule 6.3.12. Please address accordingly. Rule 6.3.3 Exhibit C- Minine Plan 4. Please be aware that all topsoil and overburden piles must be depicted on a map. Please revise the map to show the location of all stored topsoil and overburden piles. 5. The applicant states that natural seeds and grasses in the removed topsoil should provide sufficient vegetative cover for stabilization until reclamation. Disturbed areas, including topsoil and overburden piles, will need to be revegetated as soon as possible to prevent weed invasions. Please include a temporary seed mixture that will be used on stored piles to stabilize the piles from wind and water erosion and the spread of noxious weeds. Please also commit to a timely seeding of the piles. 6. Please state the anticipated acreage of the quarry, the acreage of the storage area and the anticipated depth of the quarry.
