The Division of Minerals and Geology (Division) is required to make an approval or denial decision <br />no later than August 28, 2000, therefore, your response to the following adequacy review concerns should <br />be submitted to the Division as soon as possible. <br />1. As required by Rule 1.6.3, please submit the proof of publication of the public notice circulated in the <br />local newspaper. Proof of notice may be return receipts of a Certified Mailing or by proof of personal <br />service. <br />2. Please submit the proof of notice to all owners of record of surface lands, mineral owners, easement <br />holders, and owners of record of surface lands that are within 200 feet of the boundary of the affected <br />land. Proof of notice may be return receipts of a Certified Mailing or by proof of personal service. <br />Rule 6.3.2 Exhibit B- Site Description <br />3. The applicant states that there are no permanent man-made structures with 200 feet of the affected <br />area. Please be aware that above and below ground utilities and roads are considered permanent man <br />made structures as defined by Rule l .l(48). In addition, all permanent man made structures within <br />200 feet of the affected area will need to meet the performance standards of Rule 6.3.12. Please <br />address accordingly. <br />Rule 6.3.3 Exhibit C- Minine Plan <br />4. Please be aware that all topsoil and overburden piles must be depicted on a map. Please revise the <br />map to show the location of all stored topsoil and overburden piles. <br />5. The applicant states that natural seeds and grasses in the removed topsoil should provide sufficient <br />vegetative cover for stabilization until reclamation. Disturbed areas, including topsoil and <br />overburden piles, will need to be revegetated as soon as possible to prevent weed invasions. Please <br />include a temporary seed mixture that will be used on stored piles to stabilize the piles from wind and <br />water erosion and the spread of noxious weeds. Please also commit to a timely seeding of the piles. <br />6. Please state the anticipated acreage of the quarry, the acreage of the storage area and the anticipated <br />depth of the quarry. <br />
