<br />Exhibit D - 1: Water Resources <br />a) I have met with Mr. Steve Witte of the Division of ater <br />Resources regarding the necessity to obtain a water ri ht. Based <br />on our discussion, please note the revisions to exhibi s B and D. <br />Excavation in the Del Norte Pit will proceed to a dept of 3 to 4 <br />feet. The groundwater surface in the area of the per 't site <br />rises to a depth of 5 feet. Mr. Witte agreed that be ause the <br />excavation would not increase the surface area of stan ing water <br />in the existing pit, no water permit would be required at this <br />time. <br />b) The reclamation seeding mixture recommended by the oil <br />Conservation Service is appropriate. The floor of the pit will <br />be subjected to wet conditions for a short period of time each <br />year. This period of wetness should not adversely aff ct the <br />revegetation efforts to a significant extent. Please et me know <br />if your revegetation experts recommend alternative spe ies or <br />planting methods. <br />c) As stated in the water resources exhibit, the Rio G ande <br />lateral flows approximately 250 feet away from the per it area. <br />It does not pass within 200 feet of the permit area so no <br />agreement with the ditch company should be necessary. <br />Exhibit E: <br />2) Reclamation plans will include mulching, fertilizin and <br />irrigating to increase the chances of revegetation suc ess (see <br />enclosure). <br />3) Reclamation plans are revised to specify a lower li it of 5 <br />inches for the depth of replaced topsoil (see enclosur ). <br />Exhibit F: <br />1) The Board of County Commissioners of Rio Grande Co ty has <br />granted a conditional use zoning permit for So.
