CO 81401 <br />Certified Mail Receipt No. <br />7099 3400 5263 9080 <br />Re: Unnamed Pit to be Operated by B&D Trucking (110 Permit) <br />Genliemen: <br />I am in receipt of a notice from the Colorado Division of Minerals and Geology (DMG) <br />to the Montrose County Commissioners dated April 19, 2001, advising that B&D <br />Trucking plans to 'conduct surface extraction of construction materials' in Montrose <br />County located at or neaz S1Q, T48N, R10W, N.M.P.M. <br />Under Montrose County zoning regulations, such an operation is considered a Special <br />Use. Accordingly, it will be necessary that an application for a Special Use be filed with <br />this office and that it be approved by the Boazd of County Commissioners prior to the <br />commencement of mining operations. The Mining Plan that is required by DMG is <br />usually sufficient to meet the County requirements for a site plan. <br />The DMG notice does not state whether the property will be reclaimed as "range land", <br />"farm land", or as a "water impoundment". If it will be reclaimed as range land or farm <br />land, it will not be necessary to provide a copy of the Reclamation Plan for review with <br />the Special Use. <br />In order to initiate the Special Use application process in as smooth a manner as possible, <br />I would suggest that you call the Land Use Otfice and set up apre-application review <br />meeting so that we can review the procedures to be followed and the application materials <br />that will be needed. <br />[ await your response and look forwazd to working with you on this matter. <br />Sincerely, <br />~~ ` <br />Richard L.
