Tingley: <br />I have reviewed the above application for adequacy and have the following <br />questions, com[aeata, and suggestions which are intended to aid you in <br />bri.nsing this application into full compliance with the law end to eha <br />satisfaction of the i:ined Land Reclamation Board. Please address each of <br />the following items in detail. <br />1. She Pieli~ay I•gp indicates that the lands to be permitted are 21.4 acres <br />to the south of the abandoned Wilcox Canal. The Hlning Plan ldap indicates <br />the possibility of utilizing lands to the north of the Wilcox Canal as a <br />reserve stockpile area or other poaeible use. If eo, the extent of the <br />lands to 6e affected Host 6e included in the total permit area. Addition- <br />ally, if modification or alteration of the existing access road will occur, <br />Chia should also be included ae affected land. Please clarify this concern <br />and, where appropriate, make the necessary adjuetmeate in the total acreage <br />to be permitted, related fees, and reclamation coat estimates. Please rsfar <br />to the definition of affected lands, Rule 1.1(2), in the Rules and Regulations. <br />2. Please notify the Division prior to Hoard conaideration~of the disposition <br />of the il. S. Army Corps of 1§-gineers 404 Permit rith regard to the ^wetianda^ <br />area. Should a 404 Permit be requirnd, it could alter the existing appli- <br />cation. <br />3. Please appro:iatate where the 5:1 •lopss could occur on the pond banks. In order to maintain a safe operating distance between the operation and <br />adjacent or intsreecting propsrtiae, thn staff recomneada that a 25 toot <br />to a 50 foot wide graasad buffer bs maintained between said property boun- <br />daries.
