STATE HIGHWAY ACCESS PERMIT #399057 June 7, 199 <br />Issued to Bowie Resources. Inc. <br />TERMS & CONDITIONS <br />I. This permit is issued in conjunction H•ith Permits Ns 399055 and N_ 399056. Subminal for design shall include <br />considerations for all of these permits. (onl}• one submittal required) If there are an}• questions regarding this <br />permit. please contact Mike Smith at (970)'_48-7231. <br />?. The Permi[tee shall design and submit for approval a left turn deceleration and acceleration lane I6 feet in width in <br />conformance with section » of [he State Highway Access Code. 2CCR 60t <br />3. The Permi«ee shall design and submit for approval a righ[ [urn deceleration and acceleration lane l2 fee[ in width <br />in conformance with section 4 of the State Highway Access Code. 2CCR 601-1. <br />4. Design of this access with auxiliazy lanes shall include, at a minimum, l~'i-inch overlay. <br />5. A Notice to Proceed, CDOT Form 1265 is required before beginning the construction of the access or any activity <br />within the highw•a}• right-of-way. Atl submi[tats, documents, plans and other items that must be completed, shall <br />be submitted and approved before a Notice to Proceed will be issued. Contact the Departmen[ (or local issuing <br />authority) for the Notice [o Proceed. <br />6. The following items are required before a Notice to Proceed will be issued: <br />(a) Construction Plans Stamped by a Colorado Registered Professional Engineer. <br />(b) Certifica[e of Insurance Liability as per Section 2.3(1 I)(h) of the Access Code. <br />(c) Traffic Con[rol Plan <br />7. The Permittee shall refer to all additional standard requirements on [he back of [his permit and any enclosed <br />additional terms, conditions, exhibits and Holed attachmen[s. <br />8. This Permit is issued in accordance with the State Highway Access Code (2 CCR 601-1), and is based in part upon <br />the information submitted by the Permittee. This permit is only for the use and pttrpose stated in the Application <br />and Permit. Any changes in traffic volumes or type, drainage, or other operational aspec[s may render this permit <br />void, requiring a new permit to be applied for based upon existing and anticipated future conditions. <br />9. Upon completion of the access, the applicant shall notify the Access Manager by cettified mail within 10 days at: <br />Colorado Department of Transpor[a[ion <br />Mike Smith Region 3 -Access Manager <br />606 South 9'" S[reet <br />Grand Junction, Colorado 81501 , <br />10. Nothing in this permit shall prohibit the chief engineer from exercising the right granted in CRS 43-3-102 <br />Including but not limited to restricting left hand turns by construction of physical medial separations. <br />11. All costs associa[ed with the installation of traffic lights for this access aze the responsibili[y of the Permit[ee. This <br />includes but is not limited to the design. construction, utility relocation, testing of ma[erials and inspection. <br />12. Water. sanitary, sewer, gas. elec[rical, communication, landscaping, and telephone installations will require <br />individual additional permits. <br />13. The Permittee is responsible for obtaining any necessary additional federal, stale and/or City/County permits or <br />cleazances required for construction of [he access. Approval of this access permit does not constitute verification <br />of this action by the Permiaee. <br />14. Any work within State Highway right-of-way shall begin after 8:30.4.M. and all work and equipment shall be off <br />the highway BEFORE 3:30 P.M. each day. <br />15. No highway lane closures or one-way traffic will be allowed. <br />l6. No work will be allowed at night, Saturdays. Sundays and legal holidays without prior authorization from the <br />Depar[ment. The Department may also restrict work within the State Highway ri_eht-of-way during adverse <br />weather conditions. <br />
