y• ., u, T
ROUTT COUNTY REGIONAL PLANNING COMMISSION
•
Ms. Susan Burgmaier
Reclamation Specialist
Colorado Division of Minerals and Geology
1313 Sherman St., Room 215
Denver, CO 80203
Co. mine at the Coal View Ranch
Dear Ms. Burgmaier.
November 16, 1994
RE: Post reclamation land use of the Sun Coal
According to the information I have been sent by Sun Coal Co., regarding the facilities to remain
on the John EIIts ranch, It is my understanding that the buildings to remain from the mining
operation include the office trailer, truck scales and scde house, electricd poles and transformers,
o weather station, the bridge over the Yampa River, a conveyor gallery over the Yampa River, a
coal recovery tunnel, a crusher pit covered with a metal shed, the shop buildings and storage
tanks. There are also two water wells that are to be transferred to Mr. Eilts. It is also my
understanding that the haul road will remain for use of the landowner.
.According to the technical revision information, these facilities were to remain as per the District
Court Order and Settlement Agreement from 1983. While it is our understandln9 that the
landowner has the right to request that certain facilities be Leff in place offer mining hes been
completed in any area, it must be clarified and understood that the facilities to be leff in place
are for the sole use of the landowner, and that these facilities must be related to the agricultural
operation of the ranch. The designation cf "light industrial" is not a County Zoning designation,
nor do we apply such designation to any other mining facilities in Routt County.
Therefore, the facilities that remain in place would be acceptable to Routt County if we are
certain that the use of those facilities are for the landowner on his own property, for agricultural
purposes, or as an approved part of an active use permit. According to our records. there is an
active permit for snowmobile tours on the property, as well as permits for various oil wells. Any
other mining, commercial, or industrial uses of the property would have to first be reviewed by the
County and appropriate approvals would have to be obtained prior to any operation.
Please contact this office if you have any further questions regarding this matter.
Sincerely,
~_ r-~
Caryn Fox
Staff Planner
' •cc: Bryan Archer, Sun Coal Co.
Michael Savage, Savage and Savage
Technical Revision 18 338-E Revised 8/95
