The structures which were to be removed or demolished and reclaimed at the facilities <br />• and tipple area included and were limited to the following: <br />1) the weather station <br />2) the ventilation fan at the coal recovery tunnel <br />3) the crusher pit and shed <br />4) the concrete portion of the coal recovery tunnel <br />5) the gravel fill associated with the tipple azea <br />Sun Coal Company and Mr. Eilts continued discussing the disposition of the five (5) <br />structures and facilities above, the Yampa sediment pond, and the facilities area in <br />general. In August 1995 Mr. Eilts agreed to retain all facilities and structures at the <br />facilities area (both north and south of the Yampa River) on his property. Mr. Eilts <br />contends that the remaining structures will be incorporated into the ongoing land uses <br />of this area. Mr. Eilts wishes were conveyed to the Division and the Colorado Mined <br />Land Reclamation Board in two separate letters dated August 22 and August 23, 1995 <br />see pages 338-C and D). In these letters, Mr. Eilts accepts the facilities area "as is" so <br />he may undertake modifications for his light industrial, commercial, recreation, and <br />ranching operations. Retention of these facilities is acceptable to the Routt Counry <br />Regional Planning Commission as long as they are for the use of the landowner on his <br />own property, which they are (see page 338-E). <br />• Therefore, no further demolition, removal, or reclamation activities are proposed by <br />Sun Coal Company for the former facilities and tipple areas from US Highway 40 to <br />the juncture with the former haul road (released from liability and bond) adjacent to the <br />shop area. <br />Sun Coal Company requested final bond release for the facilities area in 1995. In 1996 <br />CDMG granted fvnal bond release for the facilties area, from US Highway 40 to the <br />junction with the north end of the released haul road. The facilties area was <br />subsequently removed from the permit area. <br />• <br />Mid-Term Review 338-B Revised 4196 <br />
