Kiowa Clay Mine, M-2007-009 <br />Response to Adequacy Comments <br />17 April 2007 <br />Page 2 <br />Sandford property is not within 200 feet of the affected area and the applicant <br />has included this address in a good faith attempt to contact all neighbors, though <br />they may not technically require notice under Rule 1.6.2. Additionally, <br />concerning the Sandford property, the applicant, through John Cona, met with <br />representatives of the Sandford family and has notified them of the same details <br />of the proposed operation that are included on the mailed notice. <br />2. The application states 400 permitted acres, the introduction states 72 <br />acres to be disturbed by mining and an additional 20 acres for various <br />staging activities, but the mining plan under Exhibit D describes 2 phases <br />of mining (the first phase to include 10 acres). Finally, the reclamation <br />costs provided in Exhibit L are based on 80 acres of disturbance. Please <br />clarify the maximum disturbed acreage planned for the entire site over the <br />life of the mine, and commit to a maximum acreage to be disturbed at any <br />given point in time if these two agencies vary. <br />The permit boundary contains 400 acres and 72 acres subject to mining. An <br />additional 20 acres will be disturbed by access roads, stockpiles, and equipment <br />staging. The total affected acreage to be disturbed during the life of the mine is <br />92 acres. <br />Mining typically occurs in 40,000 ton annual campaigns. This style of mining <br />allows for reclamation to occur concurrently after each cell is mined, reducing the <br />total number of acres disturbed. Concurrent reclamation will reduce the total <br />disturbed acreage at any given point in time while the mine is operating. The <br />applicant/operator anticipates approximately 45 acres of exposed disturbance <br />(new disturbance plus carryover acreage and staging} in a typical year when the <br />site is in full production. However, for bonding purposes, to allow adequate time <br />for reclamation establishment following mining, the applicant/operatortyill commit <br />to bonding for 80 acres of disturbance, as shown on Exhibit L. <br />3. Please provide the source of the water to be used for dust suppression. <br />The amount of dust anticipated to be generated by the site is below any statutory <br />threshold for site-specific fugitive dust permitting. The dust levels will be below <br />nuisance level; however, fully consumable water will be trucked in (from off-site) <br />for dust suppression if determined necessary. According to Rule 6.4.7, the <br />applicant shall indicate the projected amount of water for the mining operation <br />and reclamation. In this case, dust suppression is part of the mining operation, <br />and there is no projected amount of water required because dust levels will be <br />below nuisance level. <br />
