• To the best of my knowledge, based upon my professional expertise, and to the extent <br />possible, Pond 005 at the Seneca II-W Mine was constructed in accordance with the prudent <br />state-of-the-art of earthen embankment construction. Further, the structure was <br />constructed in compliance with the approved design, to the extent possible, as specified <br />in Attachment 13-3 of Peabody Coal Company's approved mine permit. Ninor field adjustments <br />in horizontal and vertical alignment were necessary during construetion to compensate for <br />unanticipated natural conditions, to limit the disturbed area, and construct a structure <br />consistent with the existing topography. The centerline for the northern half of the <br />embankment was shifted upstream. This was done to avoid constructing the toe of the <br />embankment over an existing spring. Consequently, the ponding area shape and sideslopes <br />were adjusted to account for potential loss in pond capacity. <br />To the best of my knowledge and belief, field adjustments made during construction to the <br />structure ere in conformance with the Rules end Regulations in the intent of the approved <br />design plans end specifications (see Exhibit 73-SA). <br /> <br />Ronald J <br />Colorado <br />Conclusion <br />AU6 1 71992 <br />Date <br />Sedimentation Pond 005 does meet or exceed the design end performance requirements of the <br />CNLRB~s regulations. Peabody will inspect the pond quarterly to evaluate structural <br />integrity, storage capacity conditions, and remedial work requirements in accordance with <br />the approved mine permit.
