i <br />-9HULT8 (araval AgraamanG(Pg 1 <br />8) Shults retains the right to mine and remove gravel from <br />said pit provided that all such gravel shall be mined and removed <br />by Shults personally. Shults shall meet any applicable MSHA <br />regulations. <br />9) The County shall be entitled to place equipment as may be <br />necessary for its gravel operations in said pit and to bring power <br />to said pit for its operations. <br />10) The County agrees to comply with all requirements of the <br />Colorado Mine Land Reclamation Act with regard to reclamation of <br />said pit upon completion of its use by the County. In the event <br />Shults determines to keep said pit open after completion of its use <br />by said County, Shults shall assume the role as operator and be <br />responsible for all reclamation. <br />11) The County further agrees that while the County is using <br />said gravel pit, it will spray the gravel pit area to keep noxious <br />weeds under control. <br />12) Shults grants unto the County the first right-of-refusal <br />to meet any bona fide offer to lease said gravel pit after the <br />expiration of this agreement. <br />13) The County agrees to hold Shults harmless from any <br />liability arising from or out of the County's activities on Shults' <br />land, except ae otherwise provided herein. <br />14) This agreement shall be binding upon the parties, their <br />heirs, successors and assigns. <br />BOARD OF COUNTY COMMISSIONERS <br />RIO BLANCO COUNTY <br />By: <br />KIM A.
