• • ~~i <br />AGREEMENT <br />THIS AGREEMENT made and entered into this /~°" day of <br />April 2000, kiy and between LONNIS K. SHULTS, <br />and MARGARET J. ERUCTS, hereinafter called "Shults", and the BOARD <br />OF COUNTY COMMISSIONERS OF RIO BLANCO COiJNTY, hereinafter called <br />"County". <br />WITNESSETH: <br />THAT FOR AND IN CONSIDERATION of the premises, the parties <br />agree as follows to-wit: <br />1) Shults agrees to provide to the County, thirty Choueand <br />(30,000) yards of gravel from the gravel pit, located in Section <br />31, T1N, R95W, of the 6th P.M., County of Rio Blanco, State of <br />Colorado, being more particularly described, Cogether witY.~ an <br />easement thereto, on Exhibit "A" attached hereto and incorporated <br />herein by reference. <br />2) County shall be the operator of said gravel pit and shall <br />obtain the State permit for said pit. The permit for the gravel <br />pit shall be held in the name of Rio Blanco County. Upon <br />termination of this agreement, the County agrees to co-operate with <br />Shults in transferring said permit to Shults at Shults' option. <br />3) The parties agree that the County shall maintain and <br />grade the access road, on the easement described in Exhibit "A", in <br />a workmanlike manner while the County is removing gravel from said <br />pit. <br />4) Shults warrants that he is the owner of the gravel which <br />is the subject matter of this contract and said gravel is conveyed <br />free and clear of all liens and encumbrances. <br />5) The parties agree that the term of this agreement shall <br />be for a period of ten (10) years from the date of this agreement, <br />or until thirty thousand (30,000) yards of gravel have been removed ~' <br />from said pit, whichever occurs first. <br />6) The County agrees to keep records of all gravel removed <br />from said property and to keep the records open for inspection by <br />Shults at any reasonable time. ' <br />7) Said gravel pit may be fenced and locked by the County at <br />the County's option. Shults shall be provided with keys to =11 <br />locks provided by the County. <br />
