The impact from mining appears to be less than the use of the <br />land as a possible home site after the site is released. <br />8) Staff has requested additional information concerning both the Mining and Reclamation Plans as <br />part of the normal review process. The applicant's responses have not been received as of the <br />date of this letter. But, staff agrees, that additional information is warranted. <br />9) The applicant has indicated to staff that a Stormwater Permit maybe required. The application <br />process does not require that any other permits be approved prior to the decision. However, they <br />must be in place prior to the beginning of any disturbance to the site. Stormwater control <br />measures were discussed at the Pre-operational inspection and the applicant wi[I be noting those <br />measures in his response to staff's review. <br />10) Staff has raised questions concerning the use of water and it's source as part of the normal <br />review. The Office of State Engineer has been noticed and replied with no issues pertaining to <br />groundwater exposure. The applicant will have to provide information on water rights and <br />applicable uses. If the water source is not approved for commercial /industrial, the applicant <br />will be required to identify an approved source. <br />11) The Division has addressed the use of fuel tanks in the adequacy review. <br />12) As noted, the omission of the haul road requires new maps and staff will request that the copy at <br />the County Clerk's be legible. <br />Your letter has been forwarded to the applicant with a request that he respond to the Division conceming <br />the your noted issues. That response will be forwarded on to you as soon as it is received. Since you <br />did not request a Hearing before the Mined Land Reclamation Board, Per Rule 1.7.1(2)(c), staff will not <br />schedule the matter before the Board. However, you may appeal any Office Decision concerning the <br />application per Rule 1.4.11 if you fill that you will be directly or adversely affected or aggrieved. <br />Staff hopes this correspondence and the applicant's response will alleviate your concerns. A decision on <br />the application will not be rendered until all the applicable Rules and Regulations have been met to <br />staff s satisfaction by the applicant.
