Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has received your comments on the above referenced 1 l Oc <br />application. These comments aze considered an objection to the permit application. Due to an error of <br />omission of the haul road acreage to the proposed site, the applicant has to resubmit maps depicting the <br />haul road as part of the permit area. The applicant wishes to maintain the 110c status so the boundaries <br />along the north side will be reconfigured to reduce the overall disturbance area. Since there will be a <br />republication, new maps will be placed at the County Clerk's Office. Some of your concerns are being <br />addressed through the normal review process by the Division. Staff has the following information to <br />address you concerns: <br />1) As noted new maps should be in place at the Clerk's Office, including the revised Legal <br />Description. Those maps will be reviewed to ensure they meet the requirements of the rules. <br />2) The location map and Legal Description as presented has a scale and detail the site as required <br />by Rule 6.3.1. However, the omission of the haul road does require new maps and descriptions. <br />3) The Division accepts the overburden and topsoil placement within the permit boundaries is <br />conceptual for any new operation. Details as to the size of these stockpiles should be reflected in <br />Annual Reports. <br />4) Topsoil amounts aze estimated to be between 0 and 12 inches by staff and the NRCS. The <br />Reclamation Plan per NRCS recommendations calls for placement of approximately 6 inches of <br />soils back on the site. The applicant, should the application be approved, would be required to <br />place 4 to 6 inches of soil back, whether from salvaged, stockpiled materials or importation from <br />another source. Until excavation begins, the exact nature of topsoil depths is always a best <br />guess, even for the NRCS. <br />5) The plan notes site berms, which are to be constructed using topsoil and overburden, are to be <br />placedalong the permit edge. A commitment to maintain a 2:1 slope during mining means <br />topsoil should be protected from loss. <br />6) The Division through its review process has addressed the slope angles and the applicant has <br />agreed to reclaim to 3:1 slopes. <br />7) Per the Rules fora 110c application, a wildlife study is not required. However, the DMG has <br />noticed the Division of Wildlife and they have not responded with any issues.
