Tliis lease may be surrendered by <br /> Grace at any time by giving Lessors notice of its intention <br /> to surrender in the manner provided in paragraph 12. <br /> 10. Default; Force Majeure. In the event Grace <br /> shall default in the performance of its obligations hereunder, <br /> Lessors shall have the ri glit to give written notice of such <br /> default to Grace and if Grace does not cure such default <br /> within ninety days after receipt of such notice (or, if the <br /> event of default is the non-payment of money to Lessors by <br /> trace, within thirty days after receipt of notice), or <br /> commence action to cure such default within ninety days after <br /> receipt of such notice and thereafter diligently complete <br /> such curative action, Lessors may cancel this Mining Lease or <br /> take such legal action as they may see fit to require perform- <br /> ance by trace, provided, however, that any action or nonaction <br /> by Grace which is caused by casualties, strikes, legislation, <br /> <br />s public regulations, storms, floods, acts of Cod, civil disturb- <br /> ances, military disorders, insurrection, riots, fire, accident, <br /> explosion, or other causes beyond the control of Grace shall <br /> not be considered as defaults. In such case, in the event <br /> that trace intends to rely on the event of force majeure, <br /> Grace shall notify Lessors in writing of such occurence <br /> within thirty days after Grace discovers it. <br /> 11. Assignment. The provisions of this agreement <br /> shall inure to the benefit of and be binding upon the heirs, <br /> personal representatives, successors and assigns of the <br /> parties hereto. <br /> 12. Notices. Any notices required or permitted to <br /> be given hereunder shall be deemed properly given upon <br /> delivering or mailing, by registered or certified mail, <br /> return receipt requested, if intended for Lessors to: <br />c/o Ferris F.
