Varra Co panies, Inc. <br />2130 S. 96th Street Broomfield, Colorado 80200 Telephone (303) 666-6657 FAX 666-6743 <br />a) Under 3.1.6(a) the applicant states that "The applicant has filed for a temporary <br />substitute supply plan(a.k.a. augmentation plan) from the Colorado Division of Water <br />Resources-Office of the State Engineer." <br />Until this plan has been approved by the Division of Water Resources the applicant <br />cannot expose groundwater unless they wish to post sufficient bond to backfill the pit <br />two feet above the groundwater table. <br />Therefore, the Division is including the following stipulation to the application: <br />No groundwater may be exposed until the operator has provided written <br />evidence to the Division of Mineral and Geology of compliance with all <br />permitting requirements of the Office of the State Engineer, including <br />Senate Bill 120 for evaporative loss, or provides the Division with a <br />reclamation bond adequate to backfill the proposed pit to two feet <br />above the groundwater level. <br />Affirmed. <br />b) Table E-1-Revegetation Seed Mixture <br />The Division believes that this is an excellent seed mixture but would like to see the # pis <br />per acre of alkali sacaton and sand dropseed increased from 0.01 # pis per acre. Also <br />the seeds of these two specie should be broadcast seeded in advance of drill seeding <br />the other species in the mix. <br />Affirmed, and Thank-you for the kind remark. <br />c) in Exhibit L- Reclamation Cost Estimates, Table L-1 Revegetation Seed Mixture <br />Costs contains a footnote which states the "Species described subject to change <br />without notice as applied to affected lands. The Division cannot accept this. <br />However, minor alternations of the mix, for the purpose of research and the evaluation <br />of performance of various species may be allowed contingent upon review and <br />approval by the Division. Major alternations to the mix will require a Technical Revision. <br />Affirmed. <br />4) Exhibit L- Reclamation Costs <br />Overall the applicant has given a thorough description of disturbed area, recoiling seed <br />mixes and other cost related items. The Division cannot accept the Longs Peak <br />Equipment Company rates for tilling, fertilizing and seeding but will calculate <br />reclamation bond cost in the next few days and notify you of the estimated amount. <br />We received your financial warranty determination of $58,803.00.
