ISSUES TO BE CONSIDERED <br />Presentations to the Boazd shall be strictly limited to the issue of whether the pending application <br />complies with the requirements of the Colorado Land Reclamation Act for the Extraction of <br />Construction Materials, Sections 34-32.5-101 et seg•, C.R.S. (1999) ("Construction Materials <br />Act") and the rules and regulations promulgated by the Boazd. The parties shall limit <br />presentations to the question of whether the pending application should be approved or denied, <br />based on the issues stated below. <br />1. Has Hall-Irwin provided notazized agreements with Merit Energy Partners III, LP or an <br />appropriate engineering evaluation that demonstrates the well structures will not be damaged <br />by mining activities? (Rule 6.4.19, 34-32.5-115(4)(e)) <br />2. Has the Applicant complied with the State Engineer's rules governing injuries to water <br />rights? (Rule 3.1.6) <br />3. Has the Applicant proposed measures to minimize impacts to the hydrologic balance in the <br />alluvial aquifer beneath the proposed mine site to protect ground water quality and quantity? <br />(Rule 3.1.6) <br />4. Has the Applicant provided an adequate description of the general effect during and after the <br />proposed mining operation on the existing wildlife of the area, including temporary loss of <br />habitat and the general effect on the wildlife from increased human activity? (Rule 6.4.8) <br />
