6.4.13 EXHIBIT M -Other Permits and Licenses <br />16. The applicant specifies on-page 17 that there are approximately 1.1 acres of marsh wetland <br />within the proposed permit area. Please indicate the status of any pemiltting requirements from the U.S. <br />Army Corps of Engineers for operating in or near the wetland and the status of such permit. (Attached aze <br />review comments from the Corps of Engineers). <br />6.4.19 EXHIBIT S -Permanent Man-made Structures <br />17. Please indicate the status of the written agreements between the owners of oil and gas structures and <br />the operator pertaining to the 10 feet, 75 feet, and 150 feet setback distances verbally agreed to by the <br />owners of such stmctures. <br />18. The Boulder and Weld Irrigation Canal that nms adjacent to the railroad line across the proposed <br />permit area will need to be listed as a pem~anent man-made structure, and the operator will need to indicate <br />how they will comply with the requirements of Rule 6.4.19 for this structure. <br />Once again, I will look forwazd to your response on or before November 5, 2004 to allow adequate time <br />for review before the November 25, 2004 decision date. Rule 1.8.1 states that changes and additions to the <br />permit application must be filed with the Division and the County Clerk and Recorder.
