<br />2. The term of this lease shall com.:~nce July 1, 1975, <br />and shall continue for 15 years, terminating on July 1, 1990, nt <br />which time any and all of Corporation's interest in Lessors' <br />land shall terminate. The right-o`-way shall be utilize3 by <br />Corporation, its successors and assigns, as a rail:•ray with <br />appurtenant facilities and shall cor..-~ly with all laws, ordinances, <br />rules, regulations and orders of public authorities affecting <br />railway spur lines and the use thereof. Corporation may at any <br />and all times construct, install or replace tracks, switches, <br />guards or other railroad devices in the right-of-way describe3 <br />to facilitate operation or safety of Corporation's equip-gent on <br />the spur railway. <br />3. Corporation shall pay to Lessors monthly on the <br />1st day of each calendar month rental of $100.00, provided that <br />on the 3rd, 6th, 9th and 12th anniversaries of co.~.;iencer~ent of <br />the term hereof, said monthly rental for the ensuing three years <br />shall be $100.00 plus or minus an amount determined by multiplying <br />$100.00 by the percentage change in cost of living from July 1, 1975, <br />to the Idarch 31 next preceding such anniversary, as determined by <br />reference to the Consumer Price Index for the Denver Idetropolitan <br />Area issued by the School of Business of the University of Denver. <br />In the event the University of Denver no longer publishes a Consumer <br />Price Index, then rental shall be adjusted by virtue of reference to <br />the Consumer Price Index issued by the U.S. Bureau of Labor Statistics, <br />J.S. Department of Labor. Lessors ac!cnoculedge receipt o` $100.00 <br />rental for July, 197. As further consideration for this Agreement <br />and deemed by parties to be rental, Lessors acknoc•iledge receipt <br />from the Corporation of $1,950.00. <br />4. Lessors reserve the right, on reasonable notice to L~ <br />rOgr/.a.~,s ~~• <br />Corporation, to cross the afore-described right-of-:•ray c~:ithAUtility <br />or power lines, so long as the sa-e do not interfere :with the use <br />of the railway and right-of-way b}' Corporation as herein provided. <br />- 2 - <br />
