L•7OLF of Bo r, Colorado <br />(hereinafter called the "Lessors") and McCOY AGGREGATES, INC., a <br />Colorado corporation (hereinafter called the "Corporation"). <br />R E C I T A L S <br />A. Lessors are fee owners of the S 1/2 NE 1/4 0£ <br />Section 17, T1S, R83W of the 6th P.D7., Routt County, Colorado. <br />B. A railway spur line is presently situated over <br />and across the above-described property, and Lessors desire to <br />lease said railway spur line and a right-of-way across c•;hich it <br />passes to Corporation, for consideration. <br />NOW, THEREFORE, IN CONSIDERATION OF the mutual covenants <br />and agreements herein contained, the parties agree as follows: <br />1. Lessors hereby lease unto Corporation, its successors <br />and assigns, a right-of-way 50 feet wide, being 25 feet on each <br />side of a centerline described as follows: <br />Beginning at said centerline point on the south line <br />of said S 1/2 NE 1/4 Section 17 from crhich the E 1/4 <br />corner of said Section 17 bears N E7°03'00" E 210.63 <br />feet, thence on a curve to the right a distance of <br />647.20 feet and whose chord bears N 16°48'00" E 632.97 <br />feet to said centerline's point of ternination on the <br />east line of the S 1/2 IiE 1/~. <br />Bearings base3 on the east line of the SE 1/c, Section <br />17, T1S, P.83L•' of the 6t:^. ?.ti. bearing ?1 00°1'00" E. <br />TOGETHER WITH all of Lessors' interest in and to <br />switches, tracks, bridges, structures and fi~:tures <br />in connection crith such saur railway. It is, however, <br />understood and agreed that to Lessors' kno~.rledge they <br />have no interest or o~•nership in any of the tracks <br />or railway equipment and have no interest in the <br />property lease other than ownership of the real estate. <br /> <br />
