2
• •
8. Ability to Re-Claim Land: The Mined Land Reclamation regulations
require that a Financial Warranty be posted to ensure that sufficient
funds are available for reclamation. This Financial Warranty has been
posted by Mr. Covey.
9. Property Values (Decrease): This operation will be completely within
the boundaries of privately owned land. It will have no more effect upon
property values than the construction of a house. If anything, property
values will increase because of the gold mining. (Who ever heard of having
gold on their property decreasing the value?)
10. Wi1~91ife Impact: There will be no impact upon wildlife, according
to the Colorado Division of Wildlife.
11. wat~=_r Run-off: The U. S. Soil Conservation Dept. has assessed the
area pertaining to water run-off, re-vegetation and reclamation. Their
reports show no problems with water run-off or soil contamination.
12. Destruction of Planet: If this operation has the potential of
destroying the entire planet, everyone better make their peace with God
immediat~aly because we are on the very brink of disaster!
13. Peace and Quiet: We would like to see Sunshine Canyon remain
peaceful community. One way to do this is to allow freedom to peop~e
to pursue their life, liberty and happiness. Everyone does things from
ti.-ne to time in their pursuit of happiness and this is granted in our
Constitution. It would be very nice if each of us could have the world
just the way we want it--but the facts of life are that we all must move
over some to make room for others. We seriously and truthfully do 'not
want anyone to suffer hardship as a result of this mining operation and
will do all within our power to cooperate with the authorities, neighbors
and citizens of Sunshine. We request that they do the same.
Undar the Mining Laws of 1872, a mining claim was strictly to be
used for obtaining the mineral values from that land. The use for any
other purpose was deemed illegal. The issuance of a patent to the land
gave the owner full use of the land because it then became private
property. The building of a house on said property solely for a residence
is contrary to the intent of these rules and breaks a contract with the
government..
In all cases of law and order, the intent of the law takes precedence
over the letter of the law. It is an abomination of deceit to our
government that the lands be utilized as strictly residential when they
are, in truth, worth more (precious to our well being) as mineral lands.
We have a limited ammount of area where minerals can be extracted.
You don't go to a Kansas wheat field to dig gold and you don't dig
gold where there is none. The lands designated by nature as mineral land
must be kept open for development for the natural resources they contain
in order for the United States to maintain a place in the world market
in production of materials strategic to civilized life.
