The <br />Division of Minerals and Geology (Division) is required to make an approval or denial decision no later than July 20, <br />2006, therefore, your response to the following adequacy review concerns should be submitted to the Division as soon as <br />possible. <br />Rule 6.2.1(2) General Requirements -Mans and Exhibits <br />1. All maps (other than the indexllocation map) must show the name of the Applicant; must be prepared and signed by a <br />registered land surveyor, professional engineer, or other qualified person; and give the date prepared. Please revise <br />Exhibit C -Pre-mining Plan Map, Exhibit D -Mining Plan Maps, and Exhibit F, Reclamation Plan Map to include <br />this information. <br />Rule 6.4.1 Exhibit A -Legal Description <br />2. The Township and Range of each area to be mined appear to be mislabeled. Please verify the Township and Range <br />for each section to be mined and submit a corrected Legal description if necessary. <br />Rule 6.4.3 Exhibit C -Pre-Mining and Mining Plan Map(sl of Affected Lands <br />3. Rule 6.4.3(g) requires the applicant to show the owners name, type of structures, and location of all significant, <br />valuable, and permanent man-made structures contained on the area of affected land and within two hundred (200) <br />feet of the affected land. During the pre-operation inspection conducted on April 26, 2006, numerous man-made <br />structures were observed within two hundred feet of the affected area. Theses structures include several irrigation <br />ditches and associated culverts and headwalls on the east side of the hogback; several barbed wire fences running <br />east-west on both sides of the hogback; a potential underground cable running north-south on the west side of the <br />hogback; an earthen berm at the south end of the site; and a PVC pipe running east-west on the ground surface at the <br />south end of the site. Please revise Exhibit C -Pre-mining Plan Map to show the owners name of these structures <br />observed on the site. <br />4. The Township and Range on Exhibit C -Pre-Mining Plan map, and in the Pre-Mining Plan Notes of Exhibit C appear <br />to be mislabeled.
