Under the terms of the Division's policy on lined pits, <br />operators may choose the option to bond for 100 percent installation or replacement of a slurry <br />wall or clay liner or may select a regulated construction option and become eligible fora 20 <br />percent installation or replacement bond. In order to include provisions for liner installation as <br />part of the current application, the applicant will need to cazefully review and submit the specific <br />information specified in the Division's guide to specification preparation for slurry walls and <br />clay liners. Attached aze copies of the Division's policy memo and guide to specification <br />prepaza[ion document. Please indicate which bonding option you prefer and submit the <br />requested information as specified in the attached documents. Please respond. <br />6.4.7 EXHIBIT G -Water Information <br />7. The applicant indicates on the January 25, 2002 adequacy response that the dischazge ditch <br />from Sand Hill Reservoir is unlined and that the operator will maintain a 200 foot setback from <br />the ditch until an agreement with the owners of the ditch is secured. In the event that an <br />agreement is secured on or before the February 18, 2002 decision date such agreement can be <br />incorporated into the mine plan. If the agreement is not secured prior to the application decision <br />date, such agreement can be incorporated into the permit as a clarification and without the need <br />for a technical revision. Please respond. <br />10. The applicant states on page 25 of the application that the wash pond will be about 4 acres in <br />size. and on page 24 that water from dewatering operations will be pumped and dischazged into a <br />pond on-site then to an outlet ditch to the South Platte river. In conformance with Rule <br />6.4.7(2)(c), please provide a plan view and cross-sectional designs for the wash pond and <br />dewatering system. Such information may be included on the revised mine plan map. If this <br />information is not readily available on or before the application decision date, such information <br />can be provided via a technical revision prior to initiation of dewatering at the NCCI Pit #1. <br />Please respond. <br />6.4.10 EXHIBIT J -Vegetation Information <br />12. The applicant indicates in the January 25, 2002 adequacy response that they aze working with <br />the Platte Valley Soil Conservation District and Ron Broda of Weld County to identify noxious <br />weeds and wetland species present and to prepaze a weed control plan for the site. This <br />information has been requested by the Division in conformance with Rule 6.4.10(l)(a) and Rule <br />3.1.10(6). If this information cannot be provided on or before [he application decision date, the <br />applicant may opt to supply such information via an application for a technical revision prior to <br />disturbance a[ the site.
