Mr. Rick Vette - 4 - May 16, 1988 <br />Reclamation Costs <br />We will perform a reclamation cost estimate based upon the anticipated revisions to <br />the mining and reclamation plans when these are submitted to our office. <br />Zoning Compliance <br />Attached you will find a copy of a letter we recently received from the E1 Paso <br />County Land Use Department. This letter indicates that only a 40-acre tract <br />located in Section 22 is currently permitted for mining operations. The letter <br />also seems to indicate that E1 Paso County has not received a revised mining plan <br />or a request for Special Use approval. E1 Paso County has indicated that they may <br />still be unwilling to hear a Special Use petition until the right to enter issue is <br />resolved with the Federal Government, If this issue remains outstanding, I <br />strongly encourage Midway to immediately contact the appropriate officials and <br />resolve this issue, since the viability of the project may be in jeopardy. <br />Currently the Mined Land Reclamation Board cannot <br />permit without an operator having received county <br />encourage operators to approach the county and try <br />issues as quickly and diligently as possible. <br />approve a mining and reclamation <br />approval.
