1 <br />E'mpire~ Energy Corporation <br />1300 Broadway <br />Denver, CO 80203 <br />303-839-3391,2,3 <br />March 26, 1979 <br />A search of the archaeological site files maintained by the <br />Office of the State Archaeologist was conducted for the following <br />proposed areas: T5n`-'~91-92W, specified sections, Moffat County <br />Information from archaeological sites listed in our records <br />for these areas at the present time is attached. <br />Additionally, information regarding archaeological sites <br />pending nomination to or on the National Register of Historic Places <br />in the proposed project areas is attached. <br />However, our files are by no means complete as the vast <br />majority of Colorado has not been inventoried. There is always the <br />possibility that there are archaeological resources within the <br />proposed impact area that have not been identified. <br />• (Pri.or to disturbance, the Federal agency is required to <br />( conduct a'p=ofessional archaeological survey at the earliest stage <br />of plannir_g to locate and Identify the archaeological resources in <br />the proposed project area, and to Evaluate these resources according <br />to 36 CFR 800.10 to determine their Eligibility to the National <br />Register cf Historic Places. A Determination of Eligibility must <br />be made ir. consultation with the State Historic Preservation Officer <br />(SHPO). If the site is eligible, a Determination of Effect must also <br />be made ir. consultation with the SHPO (800.4(b)). If the proposed <br />action has an Adverse Effect (800.9), then a formal consultation <br />process between the agency, the SHPO, and the Advisory Council on <br />Historic Preservation (800.5) follows and results in a Memorandum of <br />Agreemen'c f800.5(g)) regarding the Avoidance (800.5(e)) or Mitigation <br />(800.5 (:)-)•4f Adverse Effect.
