The last point <br />that was raised by Mr. Cohen involved a commitment to long term maintenance <br />and questions concerning to what extent the facilities would be subject to <br />long term maintenance. I believe that reflects a certain misunderstanding of <br />the way the statute and regulations of the Mine and Land Board operate. <br />Battle Mountain recognizes its obligation to maintain all the facilities <br />within the permit area in a manner that complies with performance standards <br />that Davis mentioned, throughout the term of the permit. And that includes <br />the reclamation phase of the operation, until such time as the Staff and this <br />Board has determined that the land has been reclaimed to the standards of the <br />statute. I believe that it was the theory which underlies the reclamation <br />plan of this facility to return it to a no-maintenance situation in the <br />context of along term reclamation. So we recognize that, and we believe the <br />statute and regulations provide for that. <br />• MR. BARRY: Thinking on that subject, could you respond the -- there were <br />a couple questions about long term implications of the buttress? <br />MR. MASSEY: Yes. <br />MR. BARRY: I may not understand perfectly exactly what's p'ianned -- I'd <br />like to hear you address that concern. We've got a buttress of ,a certain <br />height. How do we know it's not going to fall down over the course of -- a <br />period of time? <br />MR. MASSEY: Okay. We've got the individual up here to do that, Jim <br />Johnson. Jim, could you just respond to that question? <br />MR. HOLDER: You know I think it'd be helpful if you would explain just <br />what a buttress is and just what this -- let's see, it was a grout curtain -- <br />sl urry. <br /> <br />
