Dorchester concludes that there are no renewable resource lands <br />on or adjacent to the proposed permit area. <br />The following sections include a brief description of pre- <br />and post-mining land uses and a description of each of the <br />itemized structures. Determination of whether subsidence could <br />cause material damage or diminution of reasonably foreseeable use <br />of the structures identified, pursuant to Section 2.05.6(6)(b)(i) <br />of the Regulations, is included in Section 2.0, titled Suba~idPnce <br />Survey. <br />1.1.1 Pre- and Post-Mining Land Uses (RULE 2 OS 6(6)(b)(i)(A) <br />The pre- and post-mining land uses are presented in Section <br />2.04.3 (Vol. I, pp. 76-79) and in Section 2.04.10, Attachment II <br />and Section 2.05.5 respectively, of the application and <br />subsequent submittals. <br />1.1.2 Ranch House and Accomoany_ina Building <br />The ranch buildings referenced in this report are <br />situated upon two 10-acre tracts of land (surface only) conveyed <br />to the Thompsons by Robert Jackson and John Cribbs on June 16, <br />1965. The deeds covering this transaction reserve to grantor <br />(Cribbs-Jackson) the right to mine the coal and contain an <br />explicit waiver of .all rights to surface support and releases the <br />grantors from all liability for damage resulting from subsidence. <br />A copy of the deeds as recorded are attached in Appendix C. <br />Dorchester is mining coal underground from the Cribbs-Jackson <br />property, including the area overlain by the Thompson surface, <br />pursuant to a lease executed in May 1978, between Dorchester and <br />Cribbs-Jackson. <br />4 <br />
