Otto Goemmer - "Rocky Flat Gravel" <br />File No. 82-129 <br />Dear Mr. Davis: <br />Today, I received your letter of concern in reference to the <br />application for a mining and reclamation permit for the above <br />captioned operation. I have sent a copy of your letter to the <br />operator, as is required by our Act. <br />I feel that I should reply to your letter on a point-by-point <br />basis. I have used the same numbers as you did in your letter. <br />1. I have questioned Mr. Goemmer as to the plans for the <br />existing pit and informed him that he must permit and <br />reclaim it if it was mined after July 1, 1973 (unless <br />the material was used solely in connection with his <br />ranching acCivities). In any case, I have suggested <br />that he incorporate the existing pit into his overall <br />reclamation plan. <br />2. I have analyzed Mr. Goemmer's reclamation plan and asked <br />him to give our Division some further details on the plan. <br />The plan will involve retopsoiling and revegetating the <br />site, and our Board will not release his financial <br />warranty unCil the plan has been accomplished. <br />3. The mining and reclamation permit for Chis operation, <br />if approved, will be for the life of the mine. This <br />is dictated by the planned rate of extraction and is <br />the operator's choice. The decision to allow mining <br />of the site for this period is a Huerfano County land <br />use decision and has already been made. <br />A <br />
