! X01 ELi~;1 <br />C,G S i ~\i c ~~!rFICE <br />Sec 9. TRANSFER OF LICENSE--Transfer of this license shall not be effective until it is approved by the <br />authorized officer. <br />Sec. 10. MODIFICATION OF LICENSE--(a) The licensee may request a modification of the exploration plan if <br />geologic or other conditions warrant. <br />(b) The authorized officer may adjust the terms and conditions of the license, including the stipulations, or the <br />Uncompahgre Field Office Manager may direct adjustment in the exploration plan when unforeseen conditons are <br />encountered that could result in substantial surface disturbance or damage to the environment or to improvements, or <br />when geologic or other physical conditions warrant. <br />(c) Any modification of the exploration plan is subject to approval by the Uncompahgre Field Office Manager. <br />Sec. 11. RELINQUISHh~NT OFLICENSE--The licensee may relinquish this license, in whole or in part, by filing <br />in the Colorado State Office a written relinquishment. The relinquishment shall be effective the date it is fried, <br />subject to the continued obligation of the licensee and his surety: (a) to comply with the terms and conditions of the <br />license, the exploration plan, and the regulations and, (b} to provide for the preservation of any permanent <br />improvements on the licensed lands. <br />Sea 12. REVOCATION OF LICENSE--This license may be revoked for noncompliance with the terms and <br />conditions of the license, the approved exploration plan, or the regulations afer the licensee has been notified of <br />such violation and the licensee has failed to correct the violation within the time specified in such notice. <br />Sec. 13. EQUAL OPPORTUNITY CLAUSE--This license is subject to the provisions of Executive Order No. <br />11246 of September 24, 1965, as amended, which sets forth the nondiscrimination clauses. A copy of this order may <br />be obtained from the issuing office. <br />Sec. 14. STIPULATIONS--(a) (1) Licensee shall notify the Paonia District Ranger at least one week before <br />operations aze to commence on National Forest System lands (NFS). The District Ranger must be notified 4S hours <br />in advance that heavy equipment will be moved onto NFS lands and that surface disturbing activities will commence. <br />(2) The FS must be notified of any proposed alterations to the plan of operations. Any changes to the <br />existing plan aze subject to FS review and approval. <br />(3) Licensee will be required to obtain a Road Use Permit (RUP) from the FS prior to any use of NFS <br />classified roads. Construction and maintenance of roads on the FS will be performed only upon authorization of the <br />District Ranger. New roads on the Forest will be designed and constructed to provide maximum stability and protect <br />the surface resource. All roads on the Forest will be maintained or constructed to FS specified standazds for either <br />classified or unclassified roads as appropriate and approved by the FS. <br />(4) Temporary roads and drill pads will be designed [o minimize erosion and sedimentation. Drill pads will <br />be sized to minimize surface disturbance. Drill pads will be designed to prevent or diminish overland flow from <br />entering the site during precipitation events. Pad sites will be sloped to drain spills and on-site precipitation into the <br />mud pits. If necessary, pits will be pumped out to reduce their content and insure that overflow does not occur. <br />Fluids will be contained on site; and if necessazy, disposed of off NFS lands unless approved otherwise after being <br />shown to be free of likely hazazdous materials. <br />(5) Licensee will be responsible for soil preservation/protection and final reclamation, including mitigating <br />soil losses due to erosion. Topsoil will be segregated, located to minimize soil contamination and/or loss, and used <br />in reclamation. Rock material needed for use as barriers may be sepazated during reclamation. <br />(6) All surface disturbing activities including reclamation must be supervised by an authorized <br />representative of the licensee who is awaze of the terms and conditions of the projects permits/licenses.
