Based upon experience at adjacent surface mining operations, the mining and reclamation <br />procedures described under Section 780 are effective in achieving this objective. <br />Water Rights <br />Colorado Pampa/Twentymile Coal Company holds the only registered surface water rights in the permit and <br />adjacent areas. As discussed in relation to probable hydrologic consequences, potential mining-related impacts <br />will not adversely affect downstream water users. In the event adverse impacts do occur, Colorado <br />Yampa/Twentymile Coal Company holds sufficient surface and groundwater rights to ensure mitigation. <br />Hvdroloaic Monitorine Program <br />Colorado Yampa/Twentymile Coal Company will continue to conduct a program of surface and groundwater <br />inonitorim; at the Eckman Park operations. A detailed discussion of monitoring procedures and the schedule for <br />monitoring activities is presented within Exhibit 8, Hydrologic Monitoring Program. <br />Monitoring activities will continue on a regular basis until reclamation efforts have been determined to be <br />successful based upon the revegetation success criteria of Section 780.18. The monitoring program will conform <br />with all applicable State and Federal laws and will provide a continuing means of detecting and measuring any <br />changes in the area Hydrologic environment. Hydrologic monitoring activities will address the quality and <br />quantity of both surface and groundwater systems. A copy of CYCC's most up-to-date NPDES permit is included <br />as Permit Renewal Exhibit 5, NPDES Permit. <br />Groundwater Monitoring <br />Groundrater monitoring in the permit and adjacent areas will involve measurement of groundwater levels and <br />collection of eroundwater physical data and sampling and analysis of groundwater chemical constituents. <br />Groundwater monitoring activities will encompass bedrock groundwater and shallow alluvial groundwater.
