Applicant shall continue to negotiate a land exchange or other land transfer with <br />the Bureau of Land Management for the purpose of moving the granite mining operation to <br />a site farther away from the Arkansas River. Applicant shall provide notice to the Board of <br />Commissioners of the date, time and location of all meetings where the applicant plans to <br />discuss any land transfers. Further, the Board of Commissioners shall be entitled to <br />participate in a meaningful way, in all discussions and negotiations concerning such lend <br />transfers. <br />z. Applicant shall make concerted and diligent efforts to coordinate with and <br />accommodate the operation of a tourist or passenger train service on the rail lines that serve <br />the Parkdale mining operation. Applicant shall provide notice to the Board of <br />Commissioners of the date, time and location of all meetings where Applicant plans to <br />discuss and negotiate the use of the rails for tourist or passenger service regardless of the <br />parties with whom Applicant is having such discussion or negotiation. Further, the Board <br />of Commissioners shall be entitled to participate in a meaningful way, in all discussions and <br />negotiations concerning cooperative shared use of the rail lines for various purposes. <br />aa. The County shall retain the right to modify any condition of the permit, if <br />the actual mining operation demonstrates that a condition of the permit is inadequate to <br />serve the intended purpose of the condition.
