<br />r. Proof of adequate water supply for the mining operation including dust <br />suppressant, prior to beginning operation.. <br />s. No mining activity shall take place within the estimated Floodplain <br />boundary unless permitted by appropriate agency. <br />t. The number of trucks hauling material from the mine shall be limited to <br />twenty four (24) per day. These amounts of traffic may be exceeded in the event of a <br />non-routine request for materials for emergency or other extraordinary circumstances <br />only, not to exceed six days per year without prior approval of the Board of <br />Commissioners. Examples of such non-routine occurrences would be the need to supply <br />material to a railroad company because of a bridge or track washout or to a state or local <br />government, because of a road or bridge washout. <br />u. No less than 85% of materials mined on the property shall be transported by <br />railroad. <br />v. The Applicant will run well head pressure tests on all well and adjudicated <br />springs located within a 11/2 mile radius of the boundary of the permitted area, utilizing the <br />following procedure. The Applicant will determine the location and most current record <br />owner of all such wells and springs from the records of the Colorado State Engineer. The <br />Applicant will write to each such owner within 60 days of issuance of this penttit, <br />requesting written permission to test. Each such well or spring owner shall have 30 days <br />from ttte mailing of the request to grant such permission. The Applicant will test each well <br />or spring for wtticlt permission to test is granted within 75 days of receipt of such <br />permission. Failure of the listed owner to grant permission to test within the 30 day time <br />period or to cooperate with Applicant in having the well or spring tested within the 75 day <br />period will relieve the Applicant of the obligation to test the involved well or spring. Tlie <br />Applicant will supply each well or spring owner with a copy of the test results within I S <br />days of receipt of those results by the Applicant. The County shall not take action under <br />this permit, on any complaint concerning injury or damage to a well or spring, filed by any <br />well or spring owner who refused permission for testing the well or spring. <br />w. Applicant shall prepare and implement a management plan for the control of <br />undesirable or noxious plants. Such plan shall be submitted to the Department of Plamting <br />and Zoning and to the Fremont County Weed Advisory Board for consideration and <br />recommendations. Any recontmendationsshall be incorporated into the plan unless waived <br />by the Board of Commissioners. The final plan shall become an additional condition of this <br />conditional use permit. <br />x.
