The Board finds that the Arkansas River corridor along U.S. Highway 50 <br />has become a heavily commercialized area due to the rafting industry, public recreation <br />areas that encourage heavy tourist traffic, and the Royal Gorge Bridge. Although there are <br />also residences in the area, the primary uses along the Arkansas River as it follows U. S. <br />Highway 50 are commercial or industrial in nature. <br />k. Consideration has been given to the potential impact of the proposed <br />Parkdale mining operation on the "Rails to Trails" plan. The Board finds that the mining <br />operation is proposed to be located on private property. Public access to private lands is not <br />a situation that would occur as a result of a "Rails to Trails" recreationprogrant. <br />1. The proposed operation complies with the spirit and intent to the Fremont <br />County Master Plan in ways that include, but are not limited to ,preservation of the <br />existence of waterways in their natural state, and imposition of Site Plan review Criteria <br />(conditions). <br />2. Conditional Use Permit shall be issued contingent on the acceptance and <br />observance by the Applicant of the following specified conditions: <br />Conditional Use Permit be issued for life of the mine. <br />b. The Department of Planning and Zoning will review the permit yearly, to <br />determine compliance with the conditions of the permit and forward it to the Board of <br />County Commissioners for their review as required by regulations. <br />c. Applicant shall conform to all plans, drawings and representations <br />submitted with or contained within the application except as may be inconsistent with the <br />other provisions of the permit. <br />d. Applicant shall comply with all laws and regulations of the State of <br />Colorado, its agencies or departments, the Board of County Commissioners of Fremont <br />County, and the United States of America, its agencies or departments, as now in force <br />and effect or as the same may be hereafter amended. <br />e. Applicant shall obtain and keep in effect all other permits required by any <br />outer governmental agency and as otherwise may be required by Fremonl County. <br />Revocation, suspension or expiration of any such outer permits shall revoke, suspend or <br />terminate the permit authorized hereunder, as the case ntay be. <br />E "fhe applicant shall provide t11e Department of Plamtittg and Zoning with <br />copies of arty technical revisions to its Mined Land Reclamation penttit, and with any <br />copies of any and all other permits, which may be required by any goventntental agency. <br />g. All loads of material transported from the site shall be secured to prevent <br />any material from escaping in accordance with C.R.S. 42-4-1208 as atttended. <br />CUP 97-5 PARKDALE MINE RESOLUTION PAGE 3 <br />
