The weight of the evidence demonstrates that the Applicant has met the minimum <br />requirements of Rule 3.1.6. <br />19. - Based on the specific responses to issues raised by the Objectors, as set forth above, and <br />based on the Division's recommendation, it is appropriate for the Board to approve the <br />Applicant's application for a Section 112 Reclamation Permit with the condition that <br />ground vibrations be monitored. <br />ORDER <br />• ~ '• •_... Based on the foregoing facts and conclusions of law, the Board hereby approves the <br />application~of:Benson Brothers for a Section 112 Reclamation Permit, subjecrito.the following <br />condition: <br />At the commencement of commercial operations at the project site (following site <br />preparation activities), Benson Brothers shall conduct ground vibration <br />monitoring for those activities that have the potential to cause ground vibrations. <br />Such ground vibration monitoring at the project site shall continue for 30 days <br />unless monitoring shows vibrations that could result in offsite damages. <br />Monitoring will be conducted according to a plan submitted by The Applicant <br />within 30 days of the Board hearing.
