bctobcr 20, 1980 - <br />Uepartment of Natural Resources <br />Re: MLRB File No. 80-47 <br />Page Five <br />(i) As indicated on Page E-43 of the application, the operator will <br />utilize best engineering and design practices to mitigate the <br />effect of erosion on the spent shale disposal area prior to and <br />after revegetation. These efforts will include, but not be <br />limited to, retopsoiling, reseeding and other appropriate and <br />reasonable erosion control measures, if necessary. <br />(j) Prior to construction, the operator will provide the Staff <br />Director with the final design plans for the sediment control <br />system for review. This plan will include a location map of <br />sediment ponds in relation to both the drainage areas and areas <br />of construction activity. The plan will also include a des- <br />cription of the sequence of construction activities as they <br />relate to sediment control measures and design parameters for <br />sediment ponds and spillways. <br />(4) With respect to Pir. Zimpfer's memorandum of October 8, 1980 to Mr. <br />James McArdle, the operator commits to the following: <br />(a) Tl~e operator will, as soon as practicable, specify the location <br />of the monitoring wells identified as F3R and FSR. <br />(b) The operator will equip the three surface water monitoring <br />stations with staff gauges and crest stage recorders. <br />(5) With respect to the additional hydrology related topics discussed during <br />the course of our October 9, 1980 meeting, the operator commits to the <br />following: <br />(a) The operator will evaluate the possible use of channery materials <br />in the soil cover to be applied to the processed shale embankment <br />to reduce soil erosion rates. <br />(b) The operator will develop a program to monitor erosion rates on <br />revegetated terraces and slopes on the spent shale disposal area. <br />The operator will submit this monitoring program to the Staff <br />Director for review. <br />(c) Any waste materials deemed "hazardous" for the purposes of the <br />Resource Conservation ar.3 Recovery Act, 42 U.S.C. 6901 et ~., <br />will not be disposed•of in the spent shale disposal area. <br />(6) With respect to P1r. Roy Cox's memorandum of October 9, 1980 to Mr. <br />James McArdle, the operator commits to the following: <br />(a) Prior to construction of the underdrain system for the spent shale <br />disposal area, the operator will submit said plan to the Staff <br />Director for review. The underdrain system will be designed, <br />utilizing best engineering practices, to address the effects of <br />subsidence and siltation on the system. A reasonable effort will <br />
